Terms of use DAC.Site

(Version 03/2026)

With access to the ABI customer portal DAC.Site, various machine data can be requested, displayed or transferred via any end device with an internet connection and a suitable web browser. It offers a modern presentation in predefined or customised dashboards, with simple navigation and a quick help function for the most important features. Data is displayed on the user interface in German and English in metric units. Regular security and function updates depending on the selected plan are included. One licence is required per machine.

Note: Can only be used in conjunction with a DAC.Site Premium plan

1.    Licence agreement for the collection of machine-related data when using the DAC.Site customer portal

1.1.    The operation of the machine generates data that is stored in a machine-related database. This data is sent automatically by the machine via secure communication channels in the mobile phone network and stored on servers of ABI or its service partners (geographically in Germany).

1.2.    The customer confirms that he has been informed by ABI or its contractual partners that the data generated by the machine will be transmitted to ABI and its service partners without any time restriction. The data generated is used exclusively for the following purposes:

    • Analysis by ABI or its contractual partners for service and maintenance purposes, e.g. for troubleshooting and repair
    • Utilisation by ABI for the improvement and development of products and services
    • Processing by ABI or its contractual partners to be able to provide the services and the range of services.

Any further use, in particular disclosure to third parties, must not take place without the express written consent of the customer.

1.3.    To ensure the proper functionality of data collection and transmission, as well as the provision of the customer portal DAC.Site, hardware installed and configured by ABI (modem, SIM card, and additional accessories) is required. The installed hardware is intended exclusively for the country of first placement on the market and may only be operated there. Operation in additional countries is only permitted if their legal regulations correspond to those of the intended destination country. In the event of resale of the machine, import, or operation in third countries with differing regulations, the hardware may not be lawfully used or placed on the market. ABI accepts no liability in such cases. A currently valid list of approved regions of operation can be found in Coverage List DAC.Site.pdf.

1.4.    A data volume of 1 GB per month is available per machine (12 GB/per year). This volume has been calculated for the required data transfer during normal machine utilisation. If the data volume is exceeded, this may result in an additional charge. The contracted data volume can be adjusted if necessary but is an annual subscription.

1.5.   Data transfer via the mobile phone network takes place via price zones with national and international roaming for the EU (including Switzerland and the UK) and the USA. Other roaming zones available upon request.

1.6.   If the machine is sold or leased to third parties, any agreements in place on data collection and utilisation remain valid and must be passed on to third parties.

2.    Agreement on the use of the DAC.Site customer portal

2.1.    ABI grants the customer an exclusive licence for access to the customer portal DAC.Site. The access data is personal and must not be passed on to third parties. The user is obliged to keep their data for the customer portal up to date or to inform their contact person (administrative user) of any changes. An administrative user designated by the customer within their organisation shall be responsible for managing the users.

2.2.    Personal data (including first name, surname, individual e-mail address) is collected for the registration and use of the customer portal - see link Data privacy https://www.abi-group.com/en/privacy-dac-site.html. The user's prior consent is required for this. If the user has an active user account, the existing login data can be used.

2.3.    The customer or user may request that personal data will be deleted at any time after the end and full completion of the portal use.

2.4.    Liability for indirect damages, particularly for loss of production, loss of profit, loss of use, loss of contracts and for the loss or incorrect processing of data, is excluded, unless there is proven intent or serious negligence or a breach of essential contractual obligations. In the event of a breach of material contractual obligations, liability shall be limited to the foreseeable damage typical of the contract.

3.    Agreement on the licence

3.1.    One licence per machine is required for the DAC.Site customer portal. ABI provides the customer with selected machine data on the DAC.Site customer portal for a fee. ABI shall grant the customer access to any number of users within its organisation per DAC.Site licence.

3.2.    The minimum term of the booked DAC.Site plan or DAC.Site licence is 1 year (12 months), starting from the date of invoicing of the plan or the associated device. Thereafter, the respective plan is automatically renewed for a further 12 months for a fee, unless DAC.Site is duly terminated in accordance with these provisions.

3.3.    In the event of termination of the DAC.Site licence, this must be received by us in writing no later than three months prior to the expiration date of the term.

3.4.    Optionally bookable add-on packages can only be used in conjunction with a valid DAC.Site licence. Please verify in advance whether the optional add-on package is compatible with your booked DAC.Site plan. The term and cancellation period of the add-on packages depend on the underlying DAC.Site plan. If an add-on package is booked during the term of a DAC.Site plan, its contract term begins on the booking date. Billing shall be prorated for the remaining term of the DAC.Site plan. Thereafter, the booked add-on package shall be automatically extended for a fee in accordance with the extension of the existing DAC.Site plan.

3.5.    A separate cancellation of optionally booked add-on packages must be received by us in writing no later than three months prior to the expiration of the DAC.Site license. A timely cancellation of the DAC.Site licence automatically includes all associated add-on packages. A separate cancellation of optionally booked add-on packages is not necessary in this case.

3.6.    With the purchase of a DAC.Site licence, you will receive an individual and unique registration key. The registration key is linked to the machine and the DAC.Site licence bound in the contract and is not transferable. The registration key is usually sent with the invoice. The registration key is used to activate the machine in DAC.Site and, if applicable, to register the administrative user for your organisation (see section 6).

3.7.    If the customer has an active licence for the DAC.Site customer portal, ABI must be informed in writing by the customer of the sale of the machine to third parties to change the access data to the customer portal or to terminate the use of all associated functions and access to stored content.

3.8.    Upon receipt of written termination of the contract for the DAC.Site customer portal, the customer's access to the customer portal and the use of all associated functions shall expire from this point in time. After termination of the contract, there is no entitlement to access stored content.

3.9.    Upon receipt of written termination of the contract for optional add-on packages, the use of all associated functions and access to additional stored content of the respective add-on package shall expire.

3.10.    ABI reserves the right to block access to the customer portal and/or the SIM card if the licence fee has not been paid within 14 days despite any reminder or in the event of serious breaches of the agreements set out in the terms of use. The customer shall be notified of the blocking of the licence at least two weeks in advance, stating the reasons. The licence will only be blocked if it is proportionate and no milder sanctions are available.

4.    Agreement on user management by the administrative user

4.1.    The administrative user is responsible for the administrative management of its users and the dissemination of information within its organisation.

4.2.    The administrative user shall act in the interests of their organisation and ABI to comply with the applicable licence agreements, terms of use and data privacy conditions. This includes particularly the avoidance of unauthorised data transfer to third parties.

4.3.    The administrative user is obliged to inform new users about the terms of use (https://www.abi-group.com/en/terms-of-use-dac-site.html) and data privacy (https://www.abi-group.com/en/privacy-dac-site.html) prior to registration and to obtain their consent. Consent to the terms of use and data privacy towards ABI shall be given by the administrative user when creating new users in DAC.site.

4.4.    The administrative user shall only create authorised persons within their organisation as new users.

4.5.    The administrative user is obliged to immediately adapt to changes in the user structure of his organisation (withdrawal of users, changes to data, changes to roles or authorisations). Particularly, if the role of the administrative user changes, ABI must be informed of this change.

5.    Agreement on the optional add-on package Rental

In addition to the agreements listed, the following additional agreements apply to the optional chargeable add-on package:

5.1.    The add-on package ‘Rental’ can only be used with a valid DAC.Site Premium licence.

5.2.    With the purchase of the add-on package ‘Rental’, the customer has the option of passing on the content and functions of the customer portal to their own rental customers (sub-customers). The content and functions depend on the booked plan of the customer portal of the machine. The creation of sub-accesses is only permitted as part of the add-on package ‘Rental’.

5.3.    Access to the customer portal and use of the functionalities for the rental customer depend on the period of the rental agreement between the customer and the rental customer. After the end of the rental period, the rental customer has no claim to stored content or functionalities of the customer portal.

5.4.    The customer confirms that, in the case of a rental agreement, the machine-related data generated during the operation of the machine will be processed exclusively for the purpose of contract fulfilment between the customer and the respective rental customer. This includes, for example, service and maintenance as well as other contractually agreed services. Any further use, in particular disclosure to third parties by the customer, shall not take place without the express written consent of the rental customer.

5.5.    The customer is obliged to inform its rental customers of the scope of functions of the booked plan as well as the terms of use and data privacy policy and to ensure that these are complied with. The customer is responsible for compliance with the agreements.

5.6.    The use of the add-on package by rental customers does not constitute a contractual agreement between ABI and the rental customers.

5.7.    The administrative user for rental customers is responsible for managing the rental customer's user accounts. For the administrative user, the tasks and obligations specified in Section 4 ‘Agreement on user management by the administrative user’ apply in relation to the users of the rental customer.

5.8.    The administrative user for rental customers is also responsible for managing the rental periods and rental access for the rental customer. They shall ensure that the rental customer's access and usage periods are limited to the period of the rental agreement between the customer and the rental customer.

5.9.    The applicable licence conditions, terms and termination periods are listed in Section 3 ‘Agreement on the licence’.

6.    Machine activation and registration of the administrative user

6.1.    The registration key is used to activate the machine in DAC.Site and, if necessary, to register the administrative user for your organisation. You can obtain the registration key from your ABI contact person. On receiving the registration request, ABI verifies the approval, creates an administrative user account if necessary and activates your machine linked to the registration key in DAC.Site. 7.    Glossary

7.1.    User - Is a natural person within a company who is granted access to the DAC.Site customer portal to use its services. Access and use are linked to a user account.

7.2.    Customer - is the company that is the contractor and service recipient of the DAC.Site customer portal.

7.3.    Organisation - is the internal structure of a company with its users in the context of using the DAC.Site customer portal.

7.4.    Rental customer - Is an organisation authorised by the customer to use the DAC.Site customer portal in the form of a rental agreement. The rental customer receives access to the customer portal via the customer. Setting up access and use is only permitted via a fee-based add-on package, which must be booked by the customer.

7.5.    Administrative user - Is a person of the customer named to ABI GmbH for the customer portal DAC.Site. The administrative user is responsible for the administration of the user management with the tasks and duties described in the terms of use and assigned to him/her. There are two roles for the administrative user. On the one hand, the role for the user administration of the users within his organisation (customers) and, on the other hand, the role for the user administration of the users of the rental customer, if applicable. Both roles can be fulfilled by different natural persons.
