Your rights as the data subject

You are entitled to exercise the following rights by contacting our data protection officer (controller) at the contact address below:

• information on your personal data stored by us and its processing (Article 15 GDPR),
• rectification of incorrect personal data (Article 16 GDPR),
• deletion of your data stored by us (Article 17 GDPR),
• restriction of data processing, unless we are prohibited from deletion on the grounds of statutory obligations (Article 18 GDPR),
• objection to the processing of your data stored by us (Article 21 GDPR) and
• data portability if you have agreed to data processing or concluded a contract with us. (Article 20 GDPR)

If you have given us your consent, you may revoke it at any time with immediate effect.

You are also entitled to seek further recourse by contacting your competent supervisory authority. Which supervisory authority is concerned depends on the administrative area you are residing in, your workplace or the alleged breach.

Customer portal DAC.Site

Type and purpose of processing:

We process personal data (First Name, Surname, Company, individual e-mail address) for the following purposes:

• Register and Administrate User Accounts in our customer portal
• To offer our services within the customer portal
• Communication with users via email (e.g. system notifications, machine related messages (if activated))

Legal basis and legitimate interest:

Processing is carried out in accordance with Art. 6 para. 1 lit. b GDPR based on our legitimate interest in the fulfilment of the contract.

Recipient:

Personal Data will only be passed on to the following recipients:

• ABI GmbH
• i.a. technical service provider who act as processor for the operation, provision and maintenance of our services
• the administrative user who manages the user administration of the users within his organisation (customer)
• i.a. the administrative user who manages the user administration of the rental customer’s users

The Data processed by ABI GmbH and i.a. technical service provider are stored exclusively on servers located in Germany.

There is a legitimate interest in fulfilling the tasks and obligations of administrative users for user management in accordance with Art. 6 para. 1 lit. f GDPR.

ABI GmbH has no influence on the further processing of your data, in particular the storage location, by its customers and the designated administrative user(s).

Storage Duration:

The data will be stored for the duration of the contractual relationship. After the end of the contractual relationship, we are subject to the statutory retention periods under the German Commercial Code (HGB) and will delete your data after these periods have expired.

Provision mandatory or required:

For the use of our customer portal DAC.Site the provision of data is required. Registration and use are not possible without this data.

Verwendung von Openstreetmaps:

For our customer portal DAC.Site we are using map services from Openstreemap. Openstreetmap is operated by OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom (short OSMF). We use Openstreetmap to display interactive maps with location information for your machine directly in the DAC.Site customer portal and enable you to use the map function conveniently. This service is a necessary component of our customer portal for the fulfilment of the contract. The processing of the data you provide is carried out based on a legitimate interest (Art. 6 para. 1 lit. f GDPR).

Your Internet browser or application establishes a connection to servers operated by the OSMF and located in the United Kingdom and other countries. As the operator of the customer portal, ABI GmbH has no influence on these connections and the processing of your data by the OSMF.

The data processed by OSMF includes, but is not limited to, (a) IP address, (b) browser and device type, (c) operating system, (d) referring website, (e) date and time of page visits and (f) pages viewed on OSFM websites.

The provider does not currently offer the option of simply opting out or blocking data transmission.

SSL encryption

We use state-of-the-art HTTPS encryption technology (e.g. SSL) to safeguard the security of your data during transmission. Information about your objection rights according to Art. 21 GDPR.

Individual right of objection

You have the right, for reasons arising from your situation to object at any time to the processing of personal data relating to you, which is based on Article. 6 Paragraph. (1) lit (f) GDPR (data processing based on a balance of interests); this also applies to profiling based on this provision within the meaning of Art. 4 No. 4 GDPR.

If you file an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

Change of our privacy policy

We reserve the right to amend this Privacy Policy from time to time to ensure its compliance with the current legal requirements or to incorporate modifications into our services in the Privacy Policy Statement, aiming at, for example, the introduction of new services. Glossary

User - Is a natural person within a company who is granted access to the DAC.Site customer portal to use its services. Access and use are linked to a user account.

Customer - is the company that is the contractor and service recipient of the DAC.Site customer portal.

Organisation - Is the internal structure of a company with its users in the context of using the DAC.Site customer portal.

Rental Customer - Is an organisation authorised by the customer to use the DAC.Site customer portal in the form of a rental agreement. The rental customer receives access to the customer portal via the customer. Setting up access and use is only permitted via a fee-based add-on package, which must be booked by the customer.

Administrative User - Is a person of the customer named to ABI GmbH for the customer portal DAC.Site. The administrative user is responsible for the administration of the user management with the tasks and duties described in the terms of use and assigned to him/her.
There are two roles for the administrative user. On the one hand, the role for the user administration of the users within his organisation (customers) and, on the other hand, the role for the user administration of the users of the rental customer, if applicable. Both roles can be fulfilled by different natural persons.
